
The Ninth District Court of Appeals in Beaumont has overturned the manslaughter conviction of Valyn Rose Faulk in the death of Derrick Cane.
Back in November 2018, Faulk was driving down MLK Drive when she struck the back of a Waste Management Truck that had stopped. Cane was on the back of the vehicle and was pinned between the two. He later died from his injuries.
Faulk, who was 18 at the time, received a sentence of five years probation in 2021.
The court of appeals said, “we conclude the State failed to present sufficient evidence to allow the jury to infer that Faulk was aware of but consciously disregarded a substantial and unjustifiable risk under the circumstances when viewed from her standpoint.”
