
The young woman accused of killing a Waste Management worker in a crash three years ago will learn this week whether she goes to prison or not.
21-year-old Falyn Rose Faulk is on trial in state district court for manslaughter in connection with the death of Derrick Cain in November 2018. Faulk, who was 18 at the time, was driving a Hyundi Sonata that hit the back of a garbage truck. The crash crushed the 28-year-old Cain.
A jury for the trial was chosen Monday and testimony began in the afternoon.
The jury will decide whether or not Faulk is guilty of manslaughter. If a guilty verdict is returned, she will have the option of having the jury or the judge give a punishment.
Manslaughter in Texas is a second degree felony and carries a penalty of two to 20 years in prison and a maximum $10,000 fine. Manslaughter in the penal code is “recklessly causes the death of an individual.”
Faulk was originally released from jail on bond after her indictment. However, she was sent to jail earlier this year after a drug detection patch required as a condition of her bond showed she had used marijuana. She has been in the Orange County Jail since.
